Brief Comments of Shaikh Ibn Baaz on Saheeh al-Bukhaaree #9

Urine of the animals we eat

بـسـم الله والحـمـد لله والـصلاة والـسـلام عــلى رسـول الله، وبـعـد

Imaam al-Bukhaaree رحمه الله said:

بَاب مَا جَاءَ فِي غَسْلِ الْبَوْلِ، وَقَالَ النَّبِيُّ صلى الله عليه وسلم لِصَاحِب الْقَبْرِ: كَانَ لَا يَسْتَتِرُ مِنْ بَوْلِهِ، وَلَمْ يَذْكُرْ سِوَى بَوْلِ النَّاسِ.

Book of Ablution: Chapter: Washing out urine [1] and the Prophet صلى الله عليه وسلم said about the person in the grave: “he never saved himself from being soiled with his urine” and he did not mention except the urine of the human beings [2].

Narrated Anas bin Maalik: Whenever the Prophet صلى الله عليه وسلم went to answer the call of nature, I used to bring water with which he used to clean his private parts. [3] [Saheeh al-Bukhaaree (217)]

Narrated Ibn `Abbaas: The Prophet صلى الله عليه وسلم once passed by two graves and said, "These two persons are being tortured [4] not for a major sin (to avoid). One of them never saved himself from being soiled with his urine, while the other used to go about with calumnies (to make enmity between friends)." The Prophet then took a green leaf of a date-palm tree, split it into (pieces) and fixed one on each grave. They said, "O Allah's Apostle! Why have you done so?" He replied, "I hope that their punishment might be lessened till these (the pieces of the leaf) become dry." [Saheeh al-Bukhaaree (218) and Saheeh Muslim (444)]

Shaikh Ibn Baaz رحمه الله said:

[1] By this (chapter heading), al-Bukhaaree رحمه الله is responding to those who say that the urine of the animals, whose meat we eat, is impure. And the correct opinion is that it is pure. As for those (things), whose meat we do not eat, then its urine is impure, like the urine of a human being, even though human in itself is pure.

* The urine of lion, tiger, dog is impure.

[2] By this, he (al-Bukhaaree) intended to reply to those who say that all types of urine are impure. The urine of the animals whose meat we eat is not impure, and this is the right opinion; whereas the urine of the human being is impure.

[3] This is the Shar`ee evidence for Istinjaa’ (use of water for purification) and the `Arabs used to despise (the use of water for purification and to touch their excretion with their hands). Therefore Istinjaa’ (use of water) and Istijmaar (use of 3 stones) was legislated (in Islaam) as a means for purification. And if a person can do both (simultaneously) then it is better.

[4] His صلى الله عليه وسلم saying: “These two persons are being tortured”, is evidence that they were Muslims. Had they been Kaafirs, then they would not have been punished for this; (rather they would be punished for Kufr), as Kufr is a greater sin than this.

* This is evidence that they were Muslims, because had they been Kaafirs, the Prophet صلى الله عليه وسلم would not have done that (as it is not allowed for the Prophet صلى الله عليه وسلم or the Muslims to pray for the Kaafirs after they have died upon Kufr).
